USCIS to Implement Second Phase of Premium Processing for Certain Previously Filed EB-1and EB-2 For


U.S. Citizenship and Immigration Services (USCIS) is implementing the second phase of the premium processing expansion for certain petitioners who have a pending Green Card petition under the EB-1 and EB-2 classifications. This only applies to certain previously filed Green Card petitions under the “Multinational Executive and Manager” classification or “Member of Professions with Advanced Degrees” or “Exceptional Ability seeking a national interest waiver (NIW)” classifications.

Premium Processing allows for speedy adjudication of green card petitions, where petitioners receive a decision in as few as 15 days. Premium Processing requires an additional form to be filed with USCIS and an additional fee of $2500 to be paid at the time of filing of the request.



Beginning Aug. 1, 2022, USCIS will accept premium processing requests for:

  • E13 multinational executive and manager petitions received on or before July 1, 2021; and

  • E21 NIW petitions were received on or before Aug. 1, 2021.

USCIS will reject premium processing requests for these classifications if the receipt date is after the dates listed above. USCIS has 45 days to take an adjudicative action on cases that request premium processing for these newly included classifications. USCIS will not accept new (initial) green card petitions in the classifications listed above with a premium processing request at this time.
